Federal Sentencing Guidelines
When Congress enacted the
Federal Sentencing Guidelines, it created a situation where federal crimes are punished much more harshly than the state counterparts.
The guidelines calculate a range that applies to the entire case. Once a judge determines the range of the possible punishment, the judge must consider it but is not forced or bound by it. There are other factors a judge must consider before imposing a sentence.
In addition, there are adjustments a judge can make to the guideline range. These adjustments can either increase or decreases the sentence. For example, a decrease in the guidelines may be warranted if:
- If the defendant had only a minor role in the crime or,
- If the defendant accepts responsibility for his or her acts.
